ตามที่ตลาดหลักทรัพย์แห่งประเทศไทยได้เพิ่มเครื่องหมายเตือนผู้ลงทุน (เครื่องหมาย C ต่าง ๆ) ให้ครอบคลุมเหตุการณ์ที่อาจมีผลกระทบต่อบริษัทจดทะเบียนมากยิ่งขึ้น โดยได้เริ่มใช้บังคับตั้งแต่ไตรมาส 1 ปี 2567 ที่ผ่านมา รวมถึงได้ปรับปรุงคุณสมบัติบริษัทที่จะเข้าจดทะเบียนใน SET และ mai (New Listing) นั้น

เพื่อให้การกำกับดูแลดังกล่าวครอบคลุมหลักทรัพย์ประเภทอื่น ๆ ได้แก่ ทรัสต์เพื่อการลงทุน (Trust) กองทุนรวมอสังหาริมทรัพย์ (Property Fund) และกองทุนรวมโครงสร้างพื้นฐาน (Infrastructure Fund) รวมทั้งเพื่อให้บริษัทจดทะเบียนที่เข้าข่ายอาจถูกเพิกถอนจะต้องมีฐานะการเงินและผลการดำเนินงานที่เข้มแข็งก่อนย้ายกลับมาซื้อขายอีกครั้ง            ตลาดหลักทรัพย์ฯ จึงมีแนวคิดที่จะปรับปรุงเกณฑ์ที่เกี่ยวข้อง และได้เปิดรับฟังความคิดเห็นการปรับปรุงเกณฑ์ใน 2 เรื่อง ดังนี้

1)  เพิ่มการเตือนผู้ลงทุนกรณี Trust, Property Fund, Infrastructure Fund ที่มีเหตุการณ์ที่อาจมีผลกระทบต่อฐานะการเงิน การดำเนินธุรกิจ สภาพคล่อง หรือเมื่อมีความเสี่ยงที่อาจเข้าเหตุเลิกกองทุน  ด้วยการขึ้นเครื่องหมาย เช่น CB, CS, CC, CF ในลักษณะที่สอดคล้องกับเครื่องหมายเตือนผู้ลงทุนตามเกณฑ์ที่เกี่ยวข้องสำหรับหุ้นสามัญของบริษัทจดทะเบียน

2)  ปรับปรุงคุณสมบัติในการกลับมาซื้อขาย (Resume Trading) สำหรับบริษัทจดทะเบียนที่เข้าข่ายอาจถูกเพิกถอนและจะย้ายกลับมาซื้อขาย ให้สอดคล้องกับเกณฑ์ New Listing ใหม่ ดังนี้

SET seeks public input on new warning signs for funds and amendments of delisting rules

BANGKOK, July 26, 2024 – The Stock Exchange of Thailand (SET) aims to extend the warning signs to securities beyond common shares, which are Trusts, Property Funds, and Infrastructure Funds, as well as amendments to regulations regarding listed companies subject to possible delisting to ensure that their financial health and operational performance have been strengthened before the trading of these securities can be resumed.

Following the implementation of enhanced investor warning signs (C-signs) in the first quarter of 2024 and the amendments to the qualifications of new listings on SET and Market for Alternative Investment (mai), SET is set to amend relevant criteria and is seeking public feedback as follows:

1) Expanding the warning signs by posting C symbols such as CB, CS, CC, and CF to Trusts, Property Funds, and Infrastructure Funds. These warnings will be triggered when these funds face risks or events that may impact their financial status, business operations, liquidity, or when there is a risk of fund dissolution. These requirements align with the existing rules for listed companies’ common shares.

2) Amending qualifications for resuming trading of listed companies subject to delisting to align with qualifications for new listings as follows:
